PERFORMANCE AGREEMENT / CONTRACT FOR SAND SCULPTOR EMPLOYMENT

   This document shall serve as a binding agreement of terms and conditions between Varano Sand Sculpture Company LLC / the Sultans Of Sand Worldwide  a sand sculpture services company, herein after referred to as “the Company” and __________________________ a professional master sand sculptor, herein after referred to as “the sculptor”

  The company will hire the sculptor to do specific sand sculpture related work including sketches and drawings which will be directed by the company at a specific time and location in exchange for money and other perks/compensation as described in this document.

LOCATION:

• Jesolo, (Venice) Italy. On the beach, under a tent.

DATES OF WORK:

• June 04, 05, 06, 07, 08, 09, 10, 11, 12, 13 The sculptor will arrive in Venice no later than June 03, and be ready to work on June 04 at 8:00AM. The sculptor may not depart Venice before until June 14.

WORK SCHEDULE:

• Eight hours per workday on the company schedule.  8-12 and 2-6 each day

THE WORK:

• The sculptor will create specific sand sculpture and do whatever else as directed by the company while on the clock during the workdays.
• The director is Rich Varano Or his assign
  
• The theme is Cowboys and Indians (Working title is "THE WILD WEST")
• Design sketches/drawings are required from the sculptor.
• The major poundups can be made to order from the sculptor's specifications before they arrive.
• It is a straight illustration job. No symbolism, abstraction, impressionism or "arty" interpretations will be used.  It is realism more than cartoon or stylized work.
• The sculptor may be working alone, or in a group of sculptors, & probably on more than one poundup or sculpture subject.
• The sculptor may be moved to work on other sculptures and may possibly have their work carved over by someone else at any time, per the director.
• In most cases, but not all, the sculptor will be able to create their own pre approved designs and subjects/elements, per the director.
• The director has ultimate control and the final say in all aspects of the event and the sculptor’s participation in it, at all times.
• There will be a limited number of student helpers for removing forms and shoveling. When available, they may help the sculptor carve sand or do other related tasks

• Pre approved standard advance purchase economy class round trip air tickets for this event will be provided for the sculptor at no charge. Custom (non round trip) ticket costs will be shared with the sculptor or other event organizers whom the sculptor may be working for, before or after the event.
• All reimbursements (if any) to the sculptor require advance arrangement and proper documentation/receipts.
•  The sculptor will be financially liable for the amount of any ticket bought by the company for the sculptor if the sculptor makes any changes that would affect the ticket price, including the change of any dates for other jobs, etc. If any such alteration and change fee is as a result of the company making any changes, the sculptor will not have to pay the difference.
• In some cases, the sculptor may possibly need to schedule non round trip tickets for travel to and from other events that will be determined later. In that instance the ticket purchase may happen closer to the event date, but the company reserves the right to act on tickets in a timely fashion best suited for the company.

HOSPITALITY:

• The sculptor will stay in a private room about 4-5 minutes walking distance from the tent.
• Three meals per day are provided.
• Drinking water and a toilet are provided at the tent.
• Sculptors are encouraged to bring any musical instruments they play.

PAY & COMPENSATIONS:

• The sculptor will be paid in accordance with the agreement between them and the Director for ten eight hour days.
• The sculptor will be subject to pay sanctions in 15-minute increments if they are late or not working when scheduled.
• The opening day of the show is Sunday, June 17. The sculptor is offered an optional four (4) comp days (non working days, but still with free room and meals) for June 14, 15, 16, 17. Any-or all, at the sculptor’s option. But the sculptor must attend the opening of the show (on time) if they are in Italy on the 17th.
•  The comp days are incentive only, and are not negotiable in exchange for pay considerations.
• The client indicates there may be a good chance for a night out for go-cart racing

CONDITIONS:

• The sculptor will provide his or her own carving tools.
• If there is a cause for any action, the sculptor will respond to any emails and web updates from the company within 14 days of it being sent to them. This will require that the sculptor can check email every week or so, and be able to respond before the two weeks from the SENT date expires.  No exceptions.
• There can be/often are some minor things that alter the scope of the overall project in some way(s), yet in no way affect this agreement. The sculptor will not generally be notified of these changes. However, the sculptor will be notified of any major changes that would result in a need to alter this agreement, via email and links to the event web site. If such major changes happen, each new notice/agreement will void the preceding one, and the sculptor will no longer be obligated to the pre existing contract. In this situation the sculptor will be free to decide again (in a timely fashion) if they opt IN for the new changes, or opt OUT of the contract and have no further involvement in the event.
•  SPECIAL NOTE: If the sculptor does not respond to an email containing a major change notice within two weeks after the company sends said email, the opt out is void, and the sculptor will be considered in compliance with the company and the described changes to the contract.
The sculptor will bring all the Sultans Of Sand shirts that they own, and wear them while working They may also be required to wear the sponsors shirts sometimes. The sculptor will notify the company if they do not have any Sultans of Sand shirts or need replacements. The sculptor may not wear other sand company OR sand event ID clothing or gear while on the clock, or while in the event tent for the opening day ceremonies unless they cover the branding with tape.
• <>The sculptor will be required to sign an artist release waiver which will stipulate that the company and its’ assigns are granted rights to use images and audio/video of the sculptor or their likeness and any work they do for the event for whatever other commercial purposes the company desires, without further compensation.  See the waiver below
•  A note about this waiver: This waiver does not preclude sculptors from using images of their own work done at the event for their own commercial enterprise.  While the company requires commercial usage rights, it does not now and never has asked for exclusive rights.  If the sculptor chooses to do something commercial with images of their your work that was done while working for the company, they are free to do so. But they may not use other elements or other peoples’ work done at the event without proper permissions or authorizations from the company first.
• In any instance, it is considered good form to give proper credit to the company even if the images are used in noncommercial applications, or in personal portfolios and/or web sites.
• It should be noted that while it is a fact that the sculptor is working at the Jesolo International Sand Sculpture Festival, they are not working for them. The sculptor is working for the company: Varano Sand Sculpture Company LLC. Aka The Sultans Of Sand Worldwide.
• Sculptor may not engage in self-promotion/publicity while on the job, by any means whatsoever.
• If the sculptor is contacted by a third party for commercial use of images of work they have done at any company event. The fair thing to do is to pass that contact along up the chain for first right of refusal to the company, just as the company would in turn kick it up to the Client. 
• The sculptor is a representative of the company the entire time they are in Italy for this event. Therefore they are expected to act responsibly at all times & not just while working. The sculptor may be subject to sanctions up to and including early termination without pay if warranted as determined by the director or the end client.

OTHER / MISCELLANEOUS:

• It is typically very hot in Jesolo during the event, but is has also been cold and wet at that time of year as well. The sculptor shall prepare accordingly.
• The Biannale art show in Venice is on this summer, Admission tickets are only about 15 euros and bus & boat tickets to Venice are less than that.
• As yet there is no wrap party planned this year, but it may be a BBQ on the beach.
• Sculptor shall submit or update emergency contact info to the company in case people need to be contacted on the sculptor’s behalf while working at this event.As a subcontractor to the company., the sculptor will provide proof of insurance, and not hold the company liable for any loss incured while on the job.
  

• The competent court for any disputes relating to or dependent on this agreement is the Court of Volusia County, Florida, USA.

ARTIST RELEASE FORM

   I grant the right to use images and/or audio/video of myself or my likeness and the work I create for Varano Sand Sculpture Company LLC, in Italy, summer 2007 to: Rich Varano, Varano Sand Sculpture Company LLC / Sultans of Sand Worldwide Sand Sculpture Services and their respective assigns, for any and all commercial purposes they desire without reservation or further compensation.
